This privacy policy sets out how Empowered Training Centre, LLC (referred further herein, as ETC), doing business through two web addresses, namely mycourseroom.com (referred further herein, as MCR) and empoweredtraining.com uses and protects any information that you provide to ETC/MCR when you use this website.

By registering at MCR, you are accepting this policy.

MCR is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website, the information we obtain will only be used in accordance set forth in the terms of this privacy statement.

MCR may change this policy from time to time by updating this page. You should check this page from time to time to ensure that you are informed of any changes. This policy has been updated and is effective as of November 15, 2020. Otherwise, acceptance of this Privacy Policy is acceptance of all future changes.

Gathering information

When you register an account with MCR in order to access and become a user on our website, we will collect the following information from you: First Name, Last Name, Email, Street Address, Phone Numbers (both mobile and home if applicable), Gender, and Age Group. If you are affiliated with an employer account, we will collect the following information from you: Employer Business Name, Street Address, Contact Number, and Website Address.

If you are a business registering an account with us, in addition to the above information, we will also collect: Industry in which your company operates, Business Name, and Location Information.

Profile information

Once you become a User, you may provide additional information to your Profile. Providing additional information about yourself, beyond what is minimally required at registration, is entirely up to you, but providing additional information enables you to derive more complete benefits from the features and functions provided for your use. Any information you provide at registration or in the Profile section may be used by MCR as described in the User Agreement and this Privacy Policy.

Connections

In order to connect with others on MCR, you may send invitations to their email addresses. The names and email addresses of people whom you invite will be used to send your invitations and reminders. Please note that when you send an invitation to connect to another User, that User will have access to your email address because it is displayed in the invitation.

What we do with the information we gather

We require this information to understand your needs, to provide you with better service, for internal record keeping purposes, and to help improve our services.

We may periodically send promotional emails about new products, special offers or other information that we believe you may find useful by using the email address that you have provided. You may choose to opt-out of this service by clicking on the unsubscribe link in the promotional emails. You can also send us an email requesting to be unsubscribed by using the form provided under the Contact Us section.

Users registered in MCR Courses will receive Course Progress related emails that inform them of their progress within each course. Notifications include email registrations, payments, start dates, deadline dates, alerts, and completion or expired information. There will not be the opportunity to unsubscribe from Course Progress related emails.

Users may also receive information on courses that have been added to MCR's catalog. These are considered promotional email and users will have the opportunity to unsubscribe from these emails.

Security

Personal information you provide will be secured in accordance with industry standards followed by our hosting provider as well as by firewalls within our technology architecture. Since the internet is not a 100% secure environment, we cannot ensure or warrant the security of any information you transmit to MCR. There is no guarantee that information may not be accessed, copied, disclosed, altered in transit or destroyed by breach of any of our physical, technical, or managerial safeguards.

You are responsible for maintaining the secrecy of your unique password, account information, and for controlling access to your email communications at all times.

Responding to legal requests and preventing harm

We may share your information in response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so or it is necessary to reveal such information in order to protect our rights or property. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves and you from violations of our Statement of Rights and Responsibilities; and to prevent death or imminent bodily harm.

How we use cookies

MCR will customize our experience through the use of cookies and other technologies allowing us to recognize you when you view and interact with any of MCR's websites and web pages, features, and functionality, including mobile applications, software, and platform technology (such as using third party applications). MCR will receive and collect your IP address, browser type, operating system, email patterns, mobile carrier if using a mobile application, location data passed to MCR from third-party services, your ISP, and the URLs of sites from which you arrive or leave the MCR websites.

To tailor our website operations to your needs by gathering and remembering information about your preferences, we analyze web traffic when you visit a particular site. We only use this information for statistical analysis purposes, and then the data is removed from the system.

Overall, cookies help us provide you with a better website by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any information about you, other than the data you choose to share with us.

You can choose to accept or decline cookies; however, if you modify your browser setting to decline cookies, it could prevent you from taking full advantage of the services our website has to offer.

Using third-party services and visiting third-party sites

If you are logged into our website and visit a third-party site that embeds professional plugins, MCR will receive information that those pages have loaded in your web browser. MCR will use this information to customize your MCR experience, including providing you insights from your MCR dashboard.

Sharing information with third parties

We only provide data to our service partners and affiliates after we have removed your name or any other personal identifiable information from it or have combined it with other people's data in a way that it is no longer associated with you. Similarly, when we receive data about you from our partners and affiliates, we keep the data for 180 days. After that, we combine the data with other people's data in a way that it is no longer associated with you. The data we receive help us to continue providing you with top quality education and services as well as help us understand the online activity.

We do not sell, rent, or otherwise provide personal identifiable information to third parties without your consent except where it is necessary to carry out your instructions, such as processing your payment information. Also, we may share information with affiliates to provide more Services. We also provide you with the means to control whether or not your contact information is viewable to other Users through your profile.

We use the information you provide to:

  • Enable you to share your information and communicate with other Users, or provide your personal details to third parties offering combined services with MCR;
  • Administer your account with us and customize the Service we provide to you and other Users;
  • Send you Service or promotional and educational communications through email and notices on the MCR website;
  • Connect you to opportunities by providing the ability to create study groups with other Users who are taking or who have taken the courses you are currently taking, receive feedback on other courses to help decide if that course would be a benefit to you, and to connect with other professionals on the MCR website;
  • Please note that in order to fulfill your requests for paid Services, we share your payment information with our payment processor who meets the Payment Compliance Industry (PCI) standard.

MCR takes the privacy of our Users very seriously, and we do not sell, rent, or otherwise provide your personal identifiable information to third parties, except as described in this policy. We will also not share other personal information not published to your profile or generated through engagement with other MCR services without your explicit consent or to carry out your instructions (for example, to process payment information) unless disclosure is reasonably necessary in our opinion to: (1) comply with legal process, including, but not limited to, civil and criminal subpoenas, court orders or other compulsory disclosures; (2) enforce this Privacy Policy and the User Agreement; (3) respond to claims of a violation of the rights of third parties, whether or not the third party is a User, individual, or government agency; (4) respond to customer service inquiries; or (5) protect the rights, property, or personal safety of our website, our Users, or the public.

Content distributed through MCR's sharing features and third-party integrations may result in displaying some of your information outside of the MCR platform. For example, when you post content to a Group on MCR and website that is open for public discussion, your content, including your name as the contributor, may be displayed in search engine results. Or, if you have bound your MCR account to your LinkedIn, Facebook, Twitter accounts, or other social networking sites, you can easily share content into all these accounts.

Developers using MCR platform services

We collaborate with and use third parties to develop the MCR platform. These third parties, with whom we have negotiated an agreement to provide services, have agreed to our developer terms in order to build applications. Both the negotiated agreements and our Application Programming Interface (API) terms and conditions contain restrictions on access, storage and use of your information.

If you choose to use MCR's training platform as an individual user or choose to use it as a business user for MCR's training catalog, or use it to subscribe to our MCR Moodle to deploy your proprietary content to your users, or use the MCR Moodle in combination with MCR's proprietary content or MCR's affiliates content, you are required to confirm acceptance of the MCR privacy policy and user agreement. Furthermore, if you utilize Combined Services through our MCR Moodle and connect with external technology or content providers, you may be asked to confirm acceptance of the privacy policy and/or user agreement of the external Service Provider, which have not necessarily been reviewed or approved by MCR. It is your choice whether or not to make use of external service provider applications and whether to proceed under any third-party terms, and once you do, the third-party's terms, and not this policy, will govern how they handle information you provide to them directly or through your MCR account.

Also, despite our agreements and technical steps taken to restrict access to and avoid possible misuse of information, we may not screen or audit all Combined Services or Platform Applications. We also cannot guarantee that any external Service Provider will abide by our agreement. You agree that your use of Combined Services or external Service Provider is on an "as is" basis and without any warranty.

If you use any Combined Service or external Service Provider, the external Service Provider may access and share certain information about you that you have allowed them to access by agreeing to use their services.

To revoke permission granted to a Combined Service or external Service Provider at any time, you can choose to stop using their services. Note, however, that even if you revoke the permission granted a third party, your Users of MCR may still be using these services, so the external Service Provider may still have access to certain information about you, just as those Users do.

To report any suspected misuse of information, contact MCR's customer service. MCR is not responsible for your use of or inability to use any Combined Service or external Service Provider's Application, including the content, accuracy, or reliability of applications and the privacy practices or other policies of external Service Providers.

We may provide aggregated anonymous data about the usage of the external Services to third parties for purposes that we deem, in our sole discretion, to be appropriate.

Notice of all changes that materially affect ways in which your personal information may be used or shared will be posted in updates to our Privacy Policy.

Links to other websites

Our website may contain links to other websites of possible interest to you. However, if you use these links, once you leave our site, we have no control over third-party sites and therefore, we are not responsible for the protection and privacy of any information which you provide while visiting such sites, and such sites are not governed by this privacy statement. You should look at the privacy statements of those individual websites as they may differ from ours and proceed accordingly.

We will not sell, distribute, or lease your personal information to third parties.

Children and minors

Children under the age of 13 are not eligible to use our MCR Individual Service without consent of their Parents.

We offer search services to help find information within MCR.

Safe Harbor

Empowered Training Centre, LLC participates in the EU Safe Harbor Privacy Framework as administered by the United States Department of Commerce as a data controller, and has self-certified our privacy practices as consistent with U.S.-E.U. Safe Harbor principles: Notice, Choice, Onward Transfer, Access and Accuracy, Security, Data Integrity and Enforcement.

Please note that by becoming a User of MCR, you have given us your express and informed consent to transfer the data that you provide to us to the United States and to process it in the United States.

Security

In order to help secure your personal information, access to your MCR account is password-protected, and sensitive data (such as credit card information) is protected by Secure Sockets Layer (SSL) encryption when it is exchanged between your web browser and MCR. To protect any data you store on our servers, MCR also regularly audits its system for possible vulnerabilities and attacks, and we use a scalable secured-access cloud hosting provider. However, since the internet is not a 100% secure environment, we cannot ensure or warrant the security of any information you transmit to MCR. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that emails, instant messaging, text messages, and similar means of communication with other Users of MCR are not encrypted, and we strongly advise you not to communicate any confidential information through these means.

Spam, spyware or spoofing

We and our Users do not tolerate spam. If you receive spam or spoof emails, please report it to us.

You may not use our communication tools to send spam or otherwise send content that would breach our User Agreement. We scan and manually filter messages to check for spam, viruses, phishing attacks and other malicious activity or illegal or prohibited content. We may also store these messages for back-up purposes only.

Data retention

MCR will retain your information for as long as your account is active. If you wish to close your account, you may do so by contacting us at [email protected]. We may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce this Privacy Policy and User Agreement.

Notice of changes

If we make changes to this Privacy Policy we will notify you by publication here, and by other means as described in the User Agreement.

Change of control

If the ownership of ETC changes, we may transfer your information to the new owner so they can continue to operate the services provided by MCR. But they will still have to honor the commitments we have made in this Privacy Policy unless notification is made as stated above. Any third party to which ETC transfers or sells its assets will have the right to continue to use the personal and other information that you provide to us.

Your obligations

As a User, you have certain obligations to other Users. Some of these obligations are imposed by applicable law and regulations, and others have become commonplace in user-friendly communities of like-minded members:

  • You must, at all times, abide by the User Agreement and current Privacy Policy.
  • You must not provide to MCR and/or other Users information that you believe might be injurious or detrimental to your person or to your professional or social status.
  • You must keep your username and password confidential and not share it with others.

Any violation of these guidelines may lead to the restriction, suspension, or termination of your account at the sole discretion of MCR.
